La sumisión del poder público al derecho en el civil law y en el common law: estado de derecho, rule of law y su expansión al ámbito internacional
ResumenConsiderados generalmente como sinónimos, Rule of Law y Rechsstaat son diferentes. Hay diferencias sustanciales entre estas dos instituciones legales que debemos distinguir rigurosamente. La idea de la sumisión del poder público al derecho expresada a través de ambas construcciones teóricas ha trascendido las fronteras estatales y se ha instalado plenamente en el ámbito internacional. Para algunos autores, la raíz de la aplicación del principio de Rule of Law en las relaciones interestatales dentro de la sociedad internacional podría remontarse al siglo XVIII. Sin embargo, fue hasta hace unos pocos años que el análisis del Rule of Law, desde el estricto punto de vista internacional, comenzó a despegar. En este artículo el autor analiza las diferencias entre el Recgsstaat y el Rule of Law con el fin de estudiar la extensión de estos conceptos y cómo se podrían aplicar para resaltar la preeminencia de la ley a nivel internacional.AbstractGenerally regarded as synonyms, the Rule of Law and the Rechsstaat are different. There are between the two legal institutions substantial differences that we must distinguish rigorously. The idea of the public power submission to the law —expressed through both theoretical constructions— has gone beyond the State borders and, progressively, made its way into international scenario. For some authors, the root for the application of the principle of the Rule of Law to interstate relationships, within international society, could date back to the XVIII century. However, it was until a few years ago that the Rule of Law analysis, from a sttrictly international point of view, started to take off. In this article the author analyzes the differences between the Rechsstaat and the Rule of Law in order to study the extension of these conceptions and how it could be applied to highlight the preeminence of law at international level
El marco jurídico de las personas que participan en actos de violencia. Una respuesta desde el derecho internacional
La implacable “Guerra mundial contra el terrorismo”, encabezada por los
Estados Unidos de América tras los acontecimientos del 11-S de 2001, ha sido fuente de
importantes consecuencias negativas para la protección de los derechos humanos fundamentales.
La aprobación o aplicación de leyes y políticas antiterroristas al margen de la
legalidad y del Estado de derecho a nivel internacional potencia, a su vez, el riesgo de
traicionar la causa de la justicia y del imperio de la ley. En el presente artículo, el autor
analiza el marco jurídico internacional, tanto de carácter convencional como de naturaleza
consuetudinaria, que brinda protección a todas las personas que participan en las hostilidades
y en cualquier otra forma de violencia regidas por el derecho internacional humanitario.
En especial, se hace hincapié en aquellos actos vinculados a la violencia
terrorista.The relentless “Global War on Terrorism”, headed by the United States after
the events of 11-S of 2001, it has been a source of important negative consequences
for the protection of the fundamental human rights. The approval or application of laws
and antiterrorist politics apart from the legality and the Rule of Law in the international
order promotes, also, the risk of betraying the justice reason and the supremacy of the
law. In this paper, the author analyzes the conventional and customary international legal
framework which provides protection to all the people that participate in the hostilities
and in any other form of violence governed by the International Humanitarian Law.
Especially, stressing those acts linked to the terrorist violence.La “Guerre contre le Terrorisme”, présidé par les États-Unis après les actes
des 11-S de 2001, il a eu des conséquences négatives importantes en se qui concernes la
protection des Droits de l’Homme fondamentaux. L’approbation ou L’application de la loi
et de la politique antiterroriste or de la légalité et de l’État de Droit dans l’ordre international
encouragent, en outre, le risque de trahir la raison de la justice et la suprématie
de la loi. Dans cet article, l’auteur analyse la structure légale internationale conventionnelle
et coutumière qui fournit la protection à tous les gens qui participent aux hostilités
ou sont lié a d’autres formes de violence réglée par le Droit International Humanitaire.
Surtout, on va préciser spécialement les actes liés à la violence terroriste
- The rule of law at international level and the international rule of law: trends and challenges
Los intentos por promover un orden internacional basado en el Derecho recurriendo a los
postulados del Estado de Derecho –interno– no resultan novedosos en lo absoluto. No obstante lo
anterior, lo cierto es que no sería sino hasta escasos años cuando la doctrina iusinternacionalista –sobre
todo, anglo-americana– comenzaría a reivindicar el International Rule of Law como construcción teórica
que, desde una perspectiva eminentemente formal, propugnaría el imperio de la ley en las relaciones
internacionales, convirtiéndose la utilización de dicho término, por otro lado, en una cuestión recurrente
tanto en la práctica de los Estados como en la labor de algunas organizaciones internacionales,
universales y regionales. En España, salvo excepciones puntuales, la doctrina especializada ha obviado el
análisis de las potenciales manifestaciones del Estado de Derecho como instrumento para enunciar el
imperio de la ley en las relaciones internacionales. En virtud de lo anterior, y con el propósito
fundamental de contribuir al debate que parece haber comenzado a generarse dentro de la doctrina de
nuestro país en torno a esta cuestión de capital importancia, proponemos analizar la génesis y el
desarrollo que la promoción del Estado de Derecho ha experimentado en el ámbito internacional. Para tal
finalidad, y en virtud de los límites materiales del presente trabajo, tomaremos como referencia la
práctica tanto de la Asamblea como de la Secretaría General de las Naciones Unidas en la materia.
Práctica que va de la promoción de un modelo interno de Estado de Derecho a la postulación de un
modelo eminentemente internacional inspirado en tal principio. En todo caso, debemos señalar que actualmente sigue sin existir consenso en torno al alcance y contenido exacto de la vertiente
internacional de tal principio. En su lugar, hemos podido constatar la convicción de la inmensa mayoría
de Estados respecto a su importancia fundamental para promover un orden internacional basado en el
Derecho.The idea of the public power submission to the law has gone beyond the State borders and,
progressively, made its way at international level by means of a principle called by Anglo-American
doctrine the “International Rule of Law”. For some authors, the root cause for the application of the
Rule of Law to interstate relationships, within international society, could date back to the XVIII Century.
However, it was until a few years ago that the Rule of Law analysis, from a strictly international point of
view, started to take off and become a recurrent topic for the doctrine and the practice of the States and
International Organizations. In Spain, unfortunately the study of the potential manifestations of the Rule
of Law in international affairs has been scarcely addressed. Regarding the latter, and with the aim of
contributing to the debate that seems to be generating within the doctrine of our country on this question,
we are going to analyze the genesis and development that the promotion of the Rule of Law has
experienced at international level. For this purpose, we will take as reference the practice of the General
Assembly of UN related to this matter. In this light, we shall study the evolution and gradual concretion
that the Rule of Law has experienced in the heart of the UN which went from the internationalization of a
national model of Rule of Law to the postulation of an international model itself.
Crónica de derecho internacional público y derecho de la Unión Europea. Año 2014
La «Crónica de Derecho Internacional Público. Año 2014» pretende abarcar algunos de los desarrollos habidos durante 2014 en diversas instituciones y regímenes internacionales, tanto en el ámbito universal como en el ámbito regional europeo. Primero se pone de manifiesto la labor llevada a cabo por los principales órganos jurídicos de la ONU (en particular, la Sexta Comisión y la Comisión de Derecho Internacional). Después, se aborda la práctica judicial internacional, en particular la actividad de la Corte Internacional de Justicia, del Tribunal Internacional del Derecho del Mar, así como la solución de controversias en el seno de la OMC, y la actividad de la Corte Penal Internacional. De entre los distintos regímenes internacionales, se presta especial atención a los desarrollos habidos en el Derecho de la Unión Europea. También se indican los acuerdos internacionales que han conformado la práctica convencional española.The Public International Law and European Union Law report deals with some institutional and normative regime developments occurred in 2013. Starting with the United Nations, it is particularly taken into consideration the work realized by the Sixth Commission and the International Law Commission. Attention is also paid to International Tribunals, the International Criminal Court included, and the settlement of disputes in the WTO.
